By downloading, installing, accessing, or using the PixVideo Application (hereinafter referred to as "the Application," "Service," or "we"), you agree to be bound by this Terms of Service (hereinafter referred to as "Agreement"). If you do not agree with any term of this Agreement, please do not use this Application.
We reserve the right to modify this Agreement at any time. The modified Agreement will be published within the Application, and your continued use of the Application indicates your acceptance of the modified terms.
PixVideo provides the following features:
· Text-to-Video: Generate video content from text and images
· Text-to-Image: Generate new images from text and images
· Face-Swapping: Combine user-uploaded faces with specific content
· Template Videos: Create videos using preset templates
The Service is provided by us and may include third-party content and integrations.
· You must be at least 13 years old to use this Application
· If you are located in Europe and between 13-16 years old, your parent or guardian must consent to your use of this Application
· We will not intentionally provide services to users under 13 years of age
· You may log in via email, Google account, or Apple ID
· You must provide accurate, complete, and up-to-date account information
· You are responsible for your account password and all activities conducted under that account
· You must immediately notify us of any unauthorized account usage
· We have the right to suspend or terminate your account if you violate this Agreement
· After your account is suspended or terminated, your access to content and data saved in the account will be revoked
· You retain ownership of all content you generate or upload
· You warrant that all uploaded content is owned by you or you have obtained the necessary authorization
· You are responsible for ensuring that uploaded content does not infringe on third-party intellectual property rights, privacy rights, or other legal rights
You may not upload or generate materials containing:
· Illegal content or content that violates any applicable law
· Hate, harassment, threat, or violent content
· Sexual or pornographic content
· Discriminatory or defamatory content
· Content that infringes on others' privacy or portrait rights
· Unauthorized use of another person's identity, image, or voice
· False or misleading information
· Spam or advertising content
· We have the right to review, examine, delete, or refuse any user-generated content that violates this Agreement
· We may use automated tools and human review to detect violating content
· If your content is deleted, we will make reasonable efforts to notify you, but do not guarantee notification
· You consent to us accessing and processing your generated content for content moderation, violation detection, and platform management purposes
· Your content will not be used for model training or commercial purposes unless you explicitly consent
· We may retain copies of your content for lawful purposes, such as legal compliance
· This Application and all its content (including but not limited to code, design, text, images, videos, etc.) are owned by us or our licensors
· You may not copy, modify, distribute, publish, or transmit any Application content unless explicitly authorized
· This Agreement grants you only a limited, non-exclusive, revocable license to use this Application for personal, non-commercial purposes
· This Application may contain content and templates from third parties
· Such content is protected by the intellectual property rights of its original owners
· You may not use such content for commercial or other purposes without appropriate authorization
· This Application offers both free and paid features
· Certain features may require subscription or in-app purchases
· Subscription and in-app purchase terms are governed by the app store policies of Google Play and Apple App Store
· All subscriptions auto-renew unless you cancel before the end of your billing cycle
· You can cancel your subscription at any time through your app store account settings
· Any unused free trial period (if applicable) will forfeit when you purchase a subscription
· Refund policies are enforced according to app store regulations
· We may change service prices from time to time
· Price changes will be notified in advance within the Application
· Your continued use of the Application indicates your acceptance of the new prices
This Application contains ads delivered by Google AdMob.
· Ads are displayed based on your usage and device data
· We are not responsible for ad content
· Clicking on ads means you are entering third-party websites, and we are not responsible for their content
You can purchase an ad-free version (if available) through the app store to remove ads.
You agree not to engage in the following activities when using this Application:
· Any illegal or Agreement-violating activities
· Harass, abuse, defame, threaten, or intimidate others
· Upload or distribute malware, viruses, or harmful code
· Attempt unauthorized access to this Application or its servers
· Bypass, disable, or interfere with the security features of this Application
· Attempt to reverse engineer, decompile, or discover the Application source code
· Use this Application for commercial purposes without explicit authorization
· Sell, transfer, or assign your account
· Engage in any behavior that may damage this Application or other users
The Application is provided on an "as-is" and "as-available" basis. While we strive to maintain the Application, we do not warrant:
· The Application will not be interrupted or error-free
· All features within the Application are fully available on all devices or operating system versions
· Any defects or errors will be corrected
We expressly disclaim all other warranties regarding this Application, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not responsible for any content generated, uploaded, or provided by users or third parties. Any use of user-generated content is at your own risk.
To the maximum extent permitted by applicable law:
· We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to data loss, loss of profits, or business interruption
· Our total liability shall not exceed the amount you paid for this Application in the past 12 months, or if you have not paid any amount, shall not exceed $100
· Your data usage is governed by our Privacy Policy
· Please review our Privacy Policy to understand how we collect, use, and protect your information
· By using this Application, you consent to our collection and processing of your information in accordance with the Privacy Policy
We may suspend or terminate your account or your access to the Service for:
· Violation of this Agreement
· Illegal or suspected fraudulent activity
· Threats to or harm to the Application or other users
· Other reasons we deem appropriate
After account termination, all your access rights to account content will be revoked. Certain terms, such as intellectual property, disclaimers, and limitations of liability, will remain effective after termination.
This Agreement and our Privacy Policy constitute the entire agreement between you and us regarding this Application and supersede all prior agreements or statements.
We may modify this Agreement at any time. Your continued use of the Application indicates your acceptance of the modified Agreement.
If any term of this Agreement is found to be invalid or unenforceable, the other terms remain effective.
Our failure to exercise any right does not constitute a waiver of that right.
This Agreement is governed by the laws of the United States and applicable European laws. For users in Europe, this Agreement is also subject to European data protection regulations, including GDPR.
You agree to submit to the jurisdiction of the courts with authority over any disputes arising from this Agreement.
